1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the Tikgu service, including our websites, applications, and related services (the “Service”) operated by Tikgu (“we”, “our”, or “Tikgu”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the service

Tikgu provides a guided, tap-based experience to help you choose devices (e.g. smartphones, laptops, desktops, smartwatches, headsets). Based on your stated preferences (budget, use case, priorities), we generate evidence-based recommendations, including pros and cons, scores, and where available, local pricing and store information. The Service may include free and paid (e.g. Tech Guru) tiers, watchlists, comparisons, and related features.

We use automated systems and third-party data to generate recommendations. We do not guarantee the accuracy, completeness, or timeliness of product information, prices, or availability. Retailer offers and inventory change frequently. You are responsible for verifying any information on retailer or manufacturer sites before making a purchase.

3. Eligibility and account

You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

You may sign in via email (including magic link and password) or supported third-party providers (e.g. Google). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.

4. Acceptable use

You agree not to:

  • Use the Service in any way that violates applicable law or these Terms.
  • Attempt to gain unauthorized access to the Service, other accounts, or our or any third party’s systems or data.
  • Use automated means (e.g. scrapers, bots) to access or use the Service except where we expressly permit it.
  • Interfere with or disrupt the Service or the integrity or performance of our systems.
  • Transmit malware, spam, or any harmful or illegal content.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Use the Service to build a competing product or to copy our data or recommendations for commercial reuse without permission.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or for other operational or legal reasons.

5. Intellectual property

The Service, including its design, text, graphics, logos, software, and content (excluding user-generated content and third-party materials), is owned by Tikgu or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent, except for limited personal, non-commercial use consistent with the Service’s normal use.

6. Subscriptions and payments

Paid plans (e.g. Tech Guru) are subject to the subscription terms presented at sign-up or on the billing page. Fees are billed in advance (e.g. monthly or annually). You may cancel in accordance with the plan’s terms; we do not provide refunds for partial periods unless required by law or as stated in the plan. We may change fees on reasonable notice; continued use after a fee increase constitutes acceptance.

Payment processing may be handled by third parties (e.g. Polar). Your payment data is subject to their terms and privacy policies. We do not store full payment card numbers.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

OUR RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY. WE DO NOT GUARANTEE THE ACCURACY OF PRICES, AVAILABILITY, OR SUITABILITY OF ANY PRODUCT FOR YOUR NEEDS. YOU ARE SOLELY RESPONSIBLE FOR YOUR PURCHASING DECISIONS AND FOR VERIFYING INFORMATION WITH RETAILERS OR MANUFACTURERS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKGU AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, the above limitations may not apply to you to the extent prohibited.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tikgu and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights or law.

10. Third-party links and services

The Service may contain links to third-party websites or services (e.g. retailers, payment providers). We do not endorse and are not responsible for their content, privacy practices, or terms. Your use of third-party services is at your own risk. Our Disclosure page describes how we may use affiliate or partner links.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access or account for violation of these Terms, for operational reasons, or for any other reason with reasonable notice where feasible. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification, governing law) will survive termination.

12. Changes to the terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated by email or a notice in the Service. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

13. General

Governing law. These Terms are governed by the laws of the jurisdiction in which Tikgu operates, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of that jurisdiction, except where prohibited.

Entire agreement. These Terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Tikgu regarding the Service and supersede prior agreements.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Waiver. Our failure to enforce any right or provision does not waive that right or provision.
